Data protection declaration

  1. General information

1.1 This data protection declaration explains which data is collected and stored when the Internet site belonging to PIEPS GmbH, Parkring 4, 8403 Lebring, Austria (hereinafter referred to as: “PIEPS” or “we”) is used and how this data is subsequently protected by PIEPS. 1.2 This data protection declaration applies to websites and services owned and operated by PIEPS or on behalf of PIEPS. We do not have any influence over links that emanate from our services. 1.3 Protecting personal data is highly important to us. The data processing is carried out on the basis of the legal provisions, in particular according to the GDPR, the Data Protection Act (DPA) and the Telecommunications Act (TKG) 2021.

  1. Collecting, processing and using personal data

2.1 When you visit our website, the servers register information that your browser automatically sends each time you visit a web page in order to provide you with our content. We also process this data as part of our legitimate interests in implementing security measures and preventing misuse (Art 6 (1) lit f GDPR). These entries might include data about your search query, the web address, the IP address, the browser that you use, the language used by your browser, the time and date of the request as well as one or more cookies that uniquely identify your browser.

2.2 Data provided by you or automatically logged by us upon registration will only be passed on to a third party without your consent if we are required to do so by law or by a court decision or if disclosure in the event of attacks on our Internet infrastructure is needed for a legal or criminal prosecution. It will never be passed on for any other commercial or non-commercial purposes.

2.3 Service providers involved by us may process your personal data on our behalf and exclusively according to our instructions.

2.4 Contact (e.g. product recall): When you contact us, we process the personal data you provide (e.g. name, address, country, phone number, email, product details, message(s)) to answer your questions, fulfill your request or otherwise communicate with you (Art 6 (1) lit b GDPR – fulfillment of (pre-)contractual obligations and Art 6 (1) lit f GDPR – legitimate interest in documenting requests).

2.5 Integrated external content (streaming, maps): We include YouTube and Vimeo on our website to provide you with a multi-media experience. In addition, we use Google Maps to help you find dealers and display geographic information in a user-friendly way. When Google Maps is integrated, fonts (Google Fonts) may also be downloaded from Google servers to your device. Through such plug-ins, connections to the server of the respective operator are established and your data (especially your IP address, the current website, the existing cookies of the operator, as well as your device and browser settings) can be transmitted to the respective operator in order to provide you with the content.   1. Data security and storage

3.1 PIEPS implements technical and organizational security measures to protect your data that is processed by us against accidental or intentional manipulation, loss, destruction or against it being accessed by unauthorized persons. Our security measures are continuously improved in concurrence with technological developments. However, we cannot guarantee the absolute protection of data against interception, misappropriation, misuse or modification as well as accidental publication or access and unauthorized third-party activities.

3.2 Personal data will be stored for the duration of the contractual relationship as well as within the framework of the statutory retention periods; beyond that, insofar as there are legitimate interests in further processing (in particular for the assertion and defense of legal claims). Communication data will be processed until your request has been dealt with, and beyond that to the extent that (pre-)contractual obligations arise from it. If necessary, we will also retain your data for as long as possible legal claims against us are not yet time-barred; for certain claims, the limitation period can be up to 30 years.

4.1 Our website might contain links to other providers and links to social media sites (Facebook, Twitter, LinkedIn). This data protection declaration only applies to websites and services owned and operated by BD or on behalf of BD. We do not have any influence over links that emanate from our services. We are not responsible for whether these providers or the operators of the social media platforms comply with the legal data protection regulations.

  1. Use of cookies and web analysis software

5.1 Our websites use cookies in several different places. They make our services more user-friendly and effective. Cookies are small text files that are stored in your computer by your browser. The data is collected and stored solely in anonymous or pseudonymous form and it does not allow any personal conclusions to be made about you. The majority of cookies used by us are so-called “session cookies” that are deleted when you shut down your browser session. Cookies do not harm your computer and neither do they contain viruses.

5.2 Third countries: We use third-party services (YouTube, Facebook, Vimeo), which may also process data in the USA within their services (e.g. IP address, current website URL, web client, provider cookies). The U.S. does not have an adequate level of data protection and there is a risk that U.S. authorities may gain access to your data without effective legal protection. The legal basis for the transfer of your personal data to the USA is your express consent (Art 49 (1) lit a GPDR). In addition, the third-party providers assure that they have concluded internal standard contractual clauses pursuant to Art. 46 (2) lit c GDPR for the transfer to the USA.

Other

6.1 You can be given information about your stored data at any time without having to give a reason, subject to legal requirements. You can block, correct or delete your data that was collected by us at any time. In accordance with the legal provisions, you also have the right to object to processing, as well as to transfer your data. You can also revoke your consent to data collection and use at any time without giving any reasons. 6.2 Please note the data use described here whenever you visit our website. This data protection declaration is immediately valid and it replaces all previous declarations.
